This website provides information regarding a settlement in Timothy Stanger, et al., v. Marriott Hotel Services, Inc. d/b/a Gaylord Opryland Resort & Convention Center (Case No. 50-2023-CA-010709-XXXX-MB).

This settlement applies to current and former employees at Gaylord Opryland Resort & Convention Center who worked in any of the Food & Beverage outlets for whom Marriott Hotel Services, LLC, formerly known as Marriott Hotel Services, Inc. (“Marriott”) took a “tip credit,” as defined by the Fair Labor Standards Act (“FLSA”), by paying them an hourly wage lower than $7.25 plus customer tips during the applicable period of February 15, 2020, to October 1, 2022. If you receive this notice, you are eligible to join this lawsuit and to participate in the settlement of this case.

As part of a Court-approved settlement agreement of this matter (“Agreement”), Marriott has agreed to pay $300,000.00 to resolve this lawsuit, which includes payment for wages, liquidated damages, and attorneys’ fees and costs (the “qualified settlement fund”). The following sums will be paid from this Settlement Amount: (1) payments to individuals who elect to participate, like you; (2) Plaintiffs’ attorneys’ fees; (3) Plaintiffs’ litigation costs; and (4) a Court-approved payment of $3,000.00 to Mr. Stanger for his service in connection with this lawsuit.

If you participate in this settlement, your settlement check will operate as a release of any and all claims under the FLSA (as defined more specifically below), including claims for retaliation, and analogous state wage and hour laws.

If you have received this notice, you are entitled to join this case and to receive a settlement check for wages and damages in accordance with the settlement described above.

In order to join this case and recover money under the settlement, you must complete, sign, and return a Consent to Join Settlement Form. If you do not want to join, you do not need to do anything. This form must be post-marked or received electronically no later than November 17, 2023.
